- Definitions
- GetTaxi: Refers to GetTaxi Sàrl, the company offering transportation services through online or phone bookings by providing vehicles with drivers.
- Customer: Refers to any individual or legal entity using GetTaxi’s services to book a vehicle for the purpose of transporting passengers or luggage.
- Purpose and Scope of Application
These Terms and Conditions of Sale (T&Cs) and Terms and Conditions of Use (TCU) govern all services offered by GetTaxi via its website, mobile application, and by phone. They cover:
- The conditions of sale of transportation services provided by GetTaxi.
- The terms of use of the GetTaxi digital platform.
By using GetTaxi’s services, the Customer accepts these T&Cs and TCU without reservation.
- Access and Use of the Platform
4.1 Access to the Website and Application
Access to the GetTaxi platform (website and mobile application) is free. However, certain services, such as booking rides, require the provision of personal information to create a user account.
The Customer agrees to provide accurate and up-to-date information. GetTaxi disclaims any liability for the fraudulent use of the services.
4.2 Account Creation
The Customer may create an account by entering the required information (name, first name, phone number, email address). If the Customer books a ride without creating an account, GetTaxi may generate an account using the information provided during the booking process.
4.3 Customer Obligations
The Customer agrees to use GetTaxi’s services in compliance with the law and public order, without fraudulent intent. Any violation will result in the suspension or termination of the user account.
- Services Offered
- GetTaxi offers the following services:
- Immediate Booking: The Customer can book a vehicle available in real-time.
- Advance Booking: The Customer can book a vehicle for a trip at a specific date and time.
- Predefined Packages: Certain trips benefit from fixed or promotional rates, depending on the offers displayed on the website or application.
- Vehicle Categories Available:
The Customer can choose a vehicle from the following categories depending on their needs:
- Economy Sedan – Capacity: 3 passengers, 2 bags
- Minivan – Capacity: 4 passengers, 3 bags
- Large Van – Capacity: 7 passengers, 7 bags
- Premium Sedan – Capacity: 3 passengers, 2 bags
- X Large Van – Capacity: 8 passengers, 8 bags
- Available Extras:
All additional options must be booked at least 24 hours in advance. For immediate bookings, GetTaxi cannot guarantee the availability of these options.
- Rear-facing baby seat (0-12 months): CHF 15.00 per trip
- Front-facing child seat (1-4 years): CHF 15.00 per trip
- Front-facing child seat (5-11 years): CHF 15.00 per trip
- Additional ski/snowboard bag: CHF 10.00 per bag
(Each booking already includes 2 bags. Additional bags are charged extra, with a maximum of 8 bags per vehicle.)
- Additional luggage: CHF 5.00 per bag
If the number of bags exceeds the vehicle’s capacity and there is no space to add extra luggage, the Customer will need to book an additional vehicle to transport the extra luggage.
- Pricing and Payment
6.1 Pricing Calculation
The price of trips is calculated based on:
- The type of vehicle selected.
- The estimated distance and time of the trip.
- Any promotions or discounts applicable at the time of booking.
The final price is always displayed before confirmation. Once confirmed, this price is fixed and cannot be changed.
6.2 Payment Methods
The Customer can pay using the following methods:
- Credit card (Visa, Mastercard, etc.)
- Twint
- Paypal
- Cash (for immediate bookings).
- Invoice (only for companies with an approved account).
- Billing and Payment Conditions for Companies
Companies benefiting from invoicing must settle their invoices within 7 days from the date of issue. In case of non-payment within this period, the following procedure applies:
- First Reminder: If payment is not made within 7 days after the due date, a first reminder will be sent with a 10 CHF fee. The Customer will then have an additional 7 days to settle the invoice.
- Second Reminder: If payment is still not made after this second period, a second reminder will be sent with an additional fee of 10 CHF. The Customer will be given a final period of 7 days to make the payment.
- Legal Action: If payment is not made after the second reminder, GetTaxi reserves the right to initiate legal proceedings in accordance with Swiss law. All costs related to these proceedings will be borne by the Customer.
- Delivery of Service
8.1 Pickup and Delays
For immediate bookings, the availability of the driver is indicated to the Customer at the time of booking.
For advance bookings, the driver will arrive at the agreed time. A waiting time of 10 minutes is included in the base fare. After this period, additional waiting fees of 1 CHF per minute will apply.
8.2 Unexpected Delays
GetTaxi will not be held responsible for delays caused by exceptional circumstances (traffic, weather conditions, accidents). In the event of a delay by the driver, the Customer will be notified as soon as possible.
- Cancellation and Modification of Bookings
9.1 Cancellation Policy
- Cancellation more than 24 hours before the trip: Free cancellation.
- Cancellation between 12 and 24 hours before the trip: 50% of the fare will be charged.
- Cancellation less than 12 hours before the trip or in case of no-show: 100% of the fare will be charged.
9.2 Modifications
Modifications to bookings can be made up to 12 hours before the scheduled departure, subject to availability. Any modification after this period is subject to GetTaxi’s approval and may incur additional fees.
- Right of Withdrawal
According to applicable legal provisions, transportation services are not subject to a right of withdrawal. Therefore, once a booking is confirmed, it is considered final.
- Liability
11.1 GetTaxi’s Liability
GetTaxi commits to providing a quality service. However, GetTaxi cannot be held liable for delays or cancellations caused by circumstances beyond its control (force majeure, weather conditions, accidents, etc.).
11.2 Customer’s Liability
The Customer is responsible for any damage caused to the vehicle during the trip. In the event of damage, GetTaxi will charge the Customer for the repair costs.
- Intellectual Property
All elements present on GetTaxi’s website and application (texts, graphics, logos, images, videos) are protected by intellectual property laws. Any unauthorized use of these elements is strictly prohibited and exposes the infringer to legal action.
- Disputes and Applicable Law
These Terms and Conditions of Sale and Use are governed by Swiss law. In the event of a dispute arising from the use of GetTaxi’s services, the parties will seek to resolve the matter amicably. Failing an agreement, the dispute will be referred to the exclusive jurisdiction of the courts of the canton of Vaud, Switzerland.
- Changes to the Terms and Conditions
GetTaxi reserves the right to modify these Terms and Conditions of Sale and Use at any time. Any modifications will be published on the website and mobile application. The changes will take effect immediately after their publication. If the Customer disagrees with the new conditions, they may stop using GetTaxi’s services.
- Data Protection and Privacy
15.1 Data Collection and Processing
GetTaxi collects and processes the Customer’s personal data in accordance with Swiss data protection legislation and, where applicable, the General Data Protection Regulation (GDPR) for European customers. The data collected includes the information provided during the booking process (name, first name, phone number, email address).
15.2 Purpose of Data Processing
The data collected is used for:
- Processing ride bookings.
- Communicating with the Customer regarding services and updates.
- Improving the services provided by GetTaxi.
15.3 Customer Rights
The Customer has the right to access, correct, delete, and object to the processing of their personal data. These rights can be exercised by contacting GetTaxi via the email address provided in section 1.
- Cookie Policy
GetTaxi uses cookies to enhance the browsing experience on its website and for analytical purposes (audience measurement). The Customer can configure their browser to block or delete cookies. However, certain website features may no longer be available if cookies are disabled.
