2. Definitions

GetTaxi GetTaxi Sàrl: means GetTaxi Sàrl, the company offering transport services via online or telephone reservations, by providing chauffeur-driven vehicles.
Customer means any individual or legal entity using the services of GetTaxi to reserve a vehicle for the transport of passengers or luggage.

3. Purpose and scope

These General Terms and Conditions of Sale (GTCS) and General Terms and Conditions of Use (GTCU) govern all the services offered by GetTaxi via its website, its mobile application and by telephone. They cover :

The terms and conditions of sale for transport services provided by GetTaxi.
The terms of use of the GetTaxi digital platform.

By using GetTaxi's services, the Customer accepts these GTC and GCU without reservation.

4. Access to and use of the platform

4.1 Access to the website and the application

Access to the GetTaxi platform (website and mobile application) is free of charge. However, some services, such as booking journeys, require you to provide personal information to create a user account.

The Client undertakes to provide accurate and up-to-date information. GetTaxi declines all responsibility in the event of fraudulent use of the services.

4.2 Creating an account

The Customer can create an account by providing the required information (surname, first name, telephone number, email address). If the Customer books a journey without creating an account, GetTaxi can generate an account from the information provided during the booking process.

4.3 Customer obligations

The Client undertakes to use the GetTaxi services in compliance with the law and public order, without fraudulent intent. Any violation will result in the suspension or termination of the user account.

5. Services on offer

GetTaxi offers the following services:

Immediate booking The Customer can reserve an available vehicle in real time.
Booking in advance The Customer can reserve a vehicle for a journey at a specific date and time.
Predefined packages Fixed or promotional fares: certain routes have fixed or promotional fares, depending on the offers displayed on the website or app.

Vehicle categories available

Customers can choose a vehicle from the following categories according to their needs:

Economy saloon - Capacity: 3 passengers, 2 items of luggage
Minivan - Capacity: 4 passengers, 3 items of luggage
Grand Van - Capacity: 7 passengers, 7 items of luggage
Premium saloon - Capacity: 3 passengers, 2 items of luggage
Van X Large - Capacity: 8 passengers, 8 items of luggage

Additional options available

All additional options must be booked at least 24 hours in advance. For immediate bookings, GetTaxi cannot guarantee the availability of these options.

Rear-facing baby seat (0-12 months): CHF 15.00 per journey
Forward-facing child seat (1-4 years): CHF 15.00 per journey
Forward-facing child seat (5-11 years): CHF 15.00 per journey
Additional ski/snowboard bag: CHF 10.00 per bag

(Each reservation already includes 2 pieces of luggage. Additional luggage will be charged extra, up to a maximum of 8 pieces per vehicle).

Additional baggage: CHF 5.00 per bag

If the number of items of luggage exceeds the capacity of the vehicle and there is no room for additional luggage, the Customer will have to book an additional vehicle to transport the excess luggage.

6. Pricing and payment

6.1 Rate calculation

Journey prices are calculated on the basis of :

The type of vehicle selected.
The estimated distance and duration of the journey.
Any promotions or discounts applicable at the time of booking.

The final price is always displayed before confirmation. Once confirmed, this price is fixed and cannot be changed.

6.2 Payment methods

Customers can pay using the following methods:

Credit card (Visa, Mastercard, etc.)
Twint
PayPal
Cash (for immediate bookings).
Invoice (only for companies with an approved account).

7. Invoicing and payment terms for companies

Companies benefiting from invoicing must pay their invoices within 7 days of the date of issue. In the event of non-payment within this period, the following procedure applies:

First reminder If payment is not made within 7 days of the due date, an initial reminder will be sent with a charge of CHF 10. The Customer will then have a further 7 days to pay the invoice.
Second reminder If payment is still not made after this second deadline, a second reminder will be sent with an additional charge of CHF 10. The Customer will be given a final period of 7 days to make the payment.
Legal action If payment is not made after the second reminder, GetTaxi reserves the right to take legal action in accordance with Swiss law. All costs associated with such legal action will be borne by the Client.

8. Running the service

8.1 Acceptance and delays

For immediate bookings, the availability of the driver is indicated to the Customer at the time of booking. For advance bookings, the driver will arrive at the agreed time. A waiting time of 10 minutes is included in the basic fare. After this time, an additional waiting charge of CHF 1 per minute will be applied.

8.2 Unforeseen delays

GetTaxi cannot be held responsible for delays caused by exceptional circumstances (traffic, weather conditions, accidents). If the driver is delayed, the Customer will be informed as soon as possible.

9. Cancellation and modification of reservations

9.1 Cancellation policy

Cancellation more than 24 hours before the journey: cancellation free of charge.
Cancellation between 12 and 24 hours before the journey: 50 % of the fare will be charged.
Cancellation less than 12 hours before the journey or in the event of no-show: 100 % of the fare will be charged.

9.2 Modifications

Changes to bookings can be made up to 12 hours before the scheduled departure time, subject to availability. Changes after this time are subject to GetTaxi approval and may incur additional charges.

10. Right of withdrawal

In accordance with the applicable legal provisions, transport services are not subject to a right of withdrawal. Consequently, once a booking has been confirmed, it is considered definitive.

11. Liability

11.1 Responsibility of GetTaxi

GetTaxi is committed to providing a quality service. However, GetTaxi cannot be held responsible for delays or cancellations caused by circumstances beyond its control (force majeure, weather conditions, accidents, etc.).

11.2 Customer liability

The Customer is responsible for any damage caused to the vehicle during the journey. In the event of damage, GetTaxi will invoice the Customer for the cost of repairs.

12. Intellectual property rights

All elements on the GetTaxi website and application (text, graphics, logos, images, videos) are protected by intellectual property laws. Any unauthorised use of these elements is strictly prohibited and exposes the offender to legal action.

13. Disputes and applicable law

These General Terms and Conditions of Sale and Use are governed by Swiss law. In the event of a dispute arising from the use of GetTaxi services, the parties shall seek to resolve the dispute amicably. Failing agreement, the dispute will be brought before the exclusive jurisdiction of the courts of the canton of Vaud, Switzerland.

14. Modification of the General Terms and Conditions

GetTaxi reserves the right to modify these Terms and Conditions of Sale and Use at any time. Any changes will be published on the website and the mobile application. The changes will take effect immediately after publication. If the Customer does not accept the new conditions, they may cease to use GetTaxi's services.

15. Data protection and confidentiality

15.1 Data collection and processing

GetTaxi collects and processes the Customer's personal data in accordance with Swiss data protection legislation and, where applicable, the General Data Protection Regulation (GDPR) for European customers. The data collected includes the information provided during the booking process (surname, first name, telephone number, email address).

15.2 Purpose of data processing

The data collected is used for :

Process race bookings.
Communicate with the Customer regarding services and updates.
To improve the services offered by GetTaxi.

15.3 Customer rights

The Client has the right to access, rectify, delete and object to the processing of his/her personal data. These rights may be exercised by contacting GetTaxi at the email address indicated in section 1.

16. Cookie policy

GetTaxi uses cookies to improve the browsing experience on its website and for analysis purposes (audience measurement). The Customer may configure his/her browser to block or delete cookies. However, certain features of the website may no longer be available if cookies are deactivated.
